MUMBAI: Bombay excessive courtroom on Thursday pronounced its ruling and struck down the Centre’s reality verify unit (FCU) rule. HC declared the modification to IT Guidelines, 2021, “unconstitutional” and struck down the rule to determine FCUs to establish “faux, false and deceptive” details about the Centre’s enterprise posted on social media and digital platforms.

Petitions are accordingly allowed.”
Justice Chandurkar noticed the rule was obscure, over-broad and disproportionate, thus accepting all main contentions raised by Kamra and others , citing its “chilling impact”. By a 2:1 rule, HC has held the April 2023 modification as “unconstitutional”. The rule allows the Centre to arrange its FCU to tag as ‘faux, false and deceptive’ content material on social media relating to its functioning.
